A new trial date has been set for Spencer Weikal of Wellington, who is facing first degree murder charges after the death of a two year-old child in November of 2011. The trial date is set for Dec. 3 in Sumner County District Court.
Judge Scott McQuin set the trial date after a hearing late in July, and ruled on two other motions. He ruled that a taped conversation with police officials, including an alleged confession, will be admissible in court. The judge also ruled in favor of a prosecutor's motion to allow information about Weikal's activities on the night of the incident be presented at the trial.
Weikal, 24, has entered a plea of not guilty.
The case was originally set to go to trail in 2012, but was later turned over to the state attorney general's office and was continued at that time.
The incident happened on Nov. 29, 2011. Weikal was living with the child's mother, Kayla Murphy. He had taken Murphy to work and had the child in his care. Later that night he took the child to the hospital. The child was having trouble breathing and had suffered physical injuries. Hospital officials sent the two year old to Wesley Medical Center in Wichita.
The child died two days later.
Weikal was later charged with first degree murder and endangering a child.
